BOOKING TERMS & CONDITIONS
These terms and conditions are for guests who book directly with us and not through Airbnb. Guests who book on Airbnb will follow terms and conditions set out by Airbnb.
This contract is between the hosts, (referred to as ‘Escēap’) and the relevant individual making the booking on behalf of their Group (referred to as “you” or “your”). You shall ensure that all members of your Group comply with these Terms & Conditions. All bookings made are subject to these Terms & Conditions. Your booking will be confirmed once the security deposit or any payment required under these Terms & Conditions has been received by ‘Escēap’ in cleared funds. Any booking constitutes acceptance of our Terms & Conditions. You must be 18 years of age or over at the time of making this booking.
1. PAYMENT
Payment of a 100% of the total cost of your stay (which includes a £200 refundable security deposit for damage/breakages) is due to secure your dates. If payment fails to reach ‘Esceap’ in accordance with these Terms & Conditions, ‘Esceap’ will notify you immediately and you will have 24hrs to complete the payment. If full payment is not received within that 24hrs period then ‘Esceap’ will cancel the booking and release the dates back into the calendar for someone else to book.
2. SECURITY DEPOSIT
When booking the huts a £200 deposit will be added. This deposit is to take care of any unplanned costs which it may incur as a result of your stay, including without limitation: damage, breakages, exceptional cleaning costs, waste recycling sorting or delayed departure by you and housekeeper’s time reallocating items moved between huts. Guests should inform ‘Escēap’ at the commencement of hire of any damage found on arrival. ‘Escēap’ reserves the right to charge for any damage or missing items not reported by you on arrival. The security deposit will be released to you within 7 working days of departure if it is deemed that there is no reason to retain this deposit.
3. CANCELLATION BY YOU
COVID 19 only - We are following the Government guidelines with respect to COVID 19. If you have to cancel because lockdown has been imposed by the Government either in your location or the location of ‘Escēap’, we will give you the opportunity to select alternative dates. If alternative dates are not feasible then we will offer you a full refund 7 days after your booking date. If you or one of your party test positive for COVID 19 then we would work with you to find another date for your stay.
Normal Cancellation policy
It may be necessary to cancel your stay due to illness or accident. ‘Esceap’ strongly advises guests to take out full holiday insurance to cover cancellations, public liability and loss. As soon as you know that you need to cancel, please email us on esceapshepherdhuts@gmail.com. Cancellation charges are calculated from the date we receive your booking, in accordance with table below:

Security Deposit payment is returned to you on cancellation notification. You agree that if you have not arrived by 8am on the morning after your stay was due to commence, or contacted ‘Escēap’ to confirm your arrival, your stay with us will be deemed to be cancelled and the total cost will be forfeited to ‘Escēap’.
4. CANCELLATION BY US
COVID 19 only - We are following the Government guidelines with respect to COVID 19. If we are unable to open as a business and this affects your dates then we can offer you to reschedule your dates or return to you any monies paid by you for this booking.
Normal Cancellation policy
In the event of ‘Escēap’ having to cancel a booking for any reason whatsoever (including extreme weather, anything which might make the huts unsafe or unusable), its liability will be limited to all monies paid by you to ‘Escēap’ in respect of that booking up to and including the date of cancellation. These monies shall be returned to you, as soon as possible, upon any such cancellation occurring. For clarity, in no event shall ‘Escēap’ be liable for any special, indirect or consequential, costs, damages, charges or expenses incurred or suffered by you as a result of any such cancellation or for any of the following losses whether incurred directly or indirectly: pure economic loss, loss of business, goodwill, reputation or profits.
5. TERMINATION OF STAY
You are expected to maintain reasonable and appropriate standards of behaviour at all times whilst at the ‘Escēap’ shepherd’s huts. ‘Escēap’ have the right, at their sole discretion, to terminate your stay if you or members of your group are reasonably believed to be causing a nuisance to other guests, neighbours, livestock or are not treating the property with due respect. ‘Escēap’ may require all or any such persons to leave the accommodation, without refund and in such an event, and will not be liable for making any payment to you and in order to compensate ‘Escēap’ for the nuisance caused will retain all monies paid by you.
6. REFUSAL OF ENTRY
‘Escēap’ reserves the right to refuse entry to any or all guests within the party if these Terms & Conditions are not observed. Any function, celebration, party, corporate event or ceremony must be communicated in advance and have the written permission of ‘Escēap’. The huts are located in an area of outstanding natural beauty with low noise and light pollution.
7. CARE OF THE PROPERTY
During your stay you will take good care of your accommodation provided to you by ‘Escēap’. On your departure, you agree to (a) leave your accommodation in the same condition of cleanliness and tidiness as at the commencement of your booking; (b) to pay for any loss or damage caused by you, during your stay. Any items moved from other huts must be returned to the appropriate hut prior to departure. Lights must be switched off, waste recycling put in the correct bins. ‘Escēap’ reserves the right to charge you for any loss, damage or extra cleaning to our property during or after your stay.
8. NUMBER OF PERSONS USING THE HUTS
There must be no more members in your group than the property is designed to accommodate. The main huts, ‘The Willow’ and ‘The Elm’ accommodates 2 people (an infant or dog is permitted by prior arrangement, beds will not be provided). The ‘Sleepers’ accommodates 4 people, this is designed with children in mind, occupancy by adults in this hut should be arranged through ‘Escēap’.
9. LIMITATION OF LIABILITY
‘Escēap’ accepts responsibility for those arrangements that are within its control but cannot accept liability for any injury, illness, loss or damage suffered by you or any member of your party. The huts are located on a working farm, although care is taken to minimise harm there will be farming equipment and animals in the vicinity. The hut’s outdoor space is limited to the perimeter of the field in which they reside. It is your responsibility to ensure that you and your party remain in this area throughout your stay.
10. ARRIVAL AND DEPARTURE TIMES
The hire period commences at 3pm on the first day of hire and terminates at 10am on the last day of hire. Any significant delay in arrival should be notified in advance to ‘Escēap’ in order that arrangements can be made for entry into the accommodation. Any significant delay in departure may incur a charge.
11. NO SMOKING POLICY
Smoking is not allowed inside any hut. The huts are cladded internally with wood and this increases the risk of fire. ‘Escēap’ reserves the right to charge for costs of cleaning and redecoration if this provision is breached. Smoking is allowed in the outside areas.
12. PETS
Pets are not allowed at ‘Escēap’ unless it is with prior approval from the hosts. Pets are permitted to sleep in the main huts, ‘The Willow and The Elm’ in a bed provided by you. They are not permitted on the bed. . ‘Escēap’ reserves the right to charge for costs of cleaning and redecoration if this provision is breached.
13. RIGHT OF ENTRY
For the undertaking of necessary repairs, maintenance and/or inspections, which might occur during your stay ‘Escēap’ has the right of entry to the huts with agreement from the guests in order to fix any issues. Privacy of guests will be maintained at all times.
15. COMPLAINTS
In the event of any problem arising on arrival or during your stay, you should immediately bring this to the attention of ‘Escēap’ and ‘Escēap’ shall, at all times, endeavour to deal with any complaint or query promptly. ‘Escēap’ regrets that claims for compensation cannot be considered after the holiday has ended if there was no such prior notification.
16. LOST PROPERTY
‘Escēap’ will retain lost property items at their office premises for 28 days from the date of your departure. For items to be returned, ‘Escēap’ reserves the right to charge a flat administration fee of £10.00 plus postage and packaging, payment for which is required in advance. ‘Escēap’ does not accept responsibility for returning any items and will not return any food or drink left in any of the huts.
17. DELAY OR FAILURE TO PERFORM
‘Escēap’ will not be liable to you if we are prevented or delayed in performing any of our obligations to you if this is due to any cause beyond ‘Escēap’s reasonable control including (without limitation): an act of God, explosion, severe weather, flood, fire or accident; malicious damage; outbreak of disease; any form of government intervention or a third party act or omission.
18. CHANGING THESE TERMS & CONDITIONS
‘Escēap’ reserves the right to revise and amend these Terms & Conditions from time to time. You will be subject to the most recent Terms & Conditions in force at the time that you make your booking, unless any change is required to be made by law or if we notify you of the change to these Terms & Conditions before we confirm that your booking has been successful.
19. DATA PROTECTION
‘Escēap’ will only store and use the information you supply to us for the purposes of carrying out our contract with you, to collect valuable feedback about how satisfied you were with the services provided and from time to time to send information regarding special offers and promotions at ‘Escēap’. If you do not wish to receive feedback requests or promotional information please email us at esceapshepherdhuts@gmail.com.
20. THIRD PARTY RIGHTS
These Terms & Conditions are made for the benefit of you and ‘Escēap’ and is not intended to benefit any third party or be enforceable by any third party. The rights of you and ‘Escēap’ to terminate, rescind, or agree any amendment, waiver, variation or settlement under or relating to these Terms & Conditions are not subject to the consent of any third party.
21. GOVERNING LAW
These Terms & Conditions are governed by the law of England and Wales, and any dispute arising out of or in connection with these Terms & Conditions is subject to the exclusive jurisdiction of the courts of England and Wales.New paragraph
